Statement by Mr. Yagya Raj Poudyal, Second Secretary, Permanent Mission of Nepal to the United Nations, on the Special Committee on the Charter of the United Nations and on the strengthening the role of the United Nations

Mr. Chairman,

I wish to express my sincere thanks to the Chair of the Special Committee on the Charter and on the Strengthening of the Role of the Organization Ms. Maria Theofili of Greece, for her comprehensive report contained in document A/74/33 as well as to the Secretary General for his reports under this agenda item.

I associate my statement with the one delivered by the distinguished representative of the Islamic Republic of Iran on behalf of the Non-Aligned Movement.

Mr. Chairman,

Nepal attaches great importance to the work of the Special Committee on the Charter of the United Nations and on the strengthening the role of the United Nations.

Over the years, the Committee has played a crucial role in upholding the UN Charter, including in maintaining international peace and security, as well as on creating an effective international legal system through adherence to the rule of law and justice.

Nepal has profound commitment to the principles and purposes of the United Nations. We strongly believe in the centrality of the United Nations in promoting multilateralism. When the values and norms of multilateralism are at stake, the United Nations General Assembly- the main deliberative, policymaking and representative organ of the United Nation- serves as a beacon of hope for the enhancement of Multilateralism.

Mr. Chairman,

Nepal strongly believes in peaceful settlement of conflicts and disputes through negotiations and dialogues. We believe that negotiations, consultation and dialogue should be applied as primary tools of dispute settlement.

The issue of encroachment by the Security Council on the functions and powers of the General Assembly and Economic and Social Council has been frequently raised in various debates. Nepal believes that the Special Committee, by mandate, is the right forum to look into the legal aspect of this issue. The Committee, also, should not shy away in engaging deeply in the deliberations within its mandates. It should constructively engage in the topics of interest of the wider membership.

Mr. Chairman,

My delegation wishes to draw the attention towards creation of the Ad Hoc Working Group on the work of the revitalization of the General Assembly. When the Ad Hoc Working Groups are allocated resources for year-round business, the Committee created for the same job remains almost without job. This situation must be eliminated.

Nepal also stresses that the reform of the United Nations should be carried out with a view to making this great institution more democratic, transparent and accountable. This will reinforce the principles and purposes enshrined in its Charter.

Before I conclude, I wish to appreciate the work of the Secretariat for the publication of Repertory of Practice of United Nations Organs and Repertoire of the Practice of the Security Council which serves as important resources and research materials to the interested students and academicians of international law.
